The buyer of products sold by GMRS Outlet LLC is responsible for the operation of all radio devices in full compliance to FCC rules and regulations. GMRS Outlet LLC is not responsible for misuse of any radio device we sell.
According to the FCC:
Sec. 95.129 Station equipment.
Every station in a GMRS system must use transmitters the FCC has
certificated for use in the GMRS. Write to any FCC Field Office to find
out if a particular transmitter has been certificated for the GMRS.
All
station equipment in a GMRS system must comply with the technical rules
in Part 95.
All of the radios sold by GMRS Outlet LLC meet or exceed Part 90 and Part 95 specifications. However, not all products sold are Part 95 "Certified" or "type accepted". The last line of the above statement from the FCC has been interpreted by some to mean if the equipment in question complies with the technical rules in Part 95, it is okay to use for GMRS.
All Part 90 equipment sold by GMRS Outlet LLC meets or exceeds the technical requirements for Part 95. A properly configured and tuned Part 90 radio will work and meet the same technical specifications as a Part 95 radio. It is impossible to tell the difference between a Part 90 and Part 95 radio sold by GMRS Outlet LLC while it is in use, or on a test bench.
The opinion of GMRS Outlet LLC is that Part 90 radios are built to higher standards then most of the "toy" Hybrid FRS/GMRS Radios that are Part 95 accepted.
